Last May I adopted my 2 foster children. The judge allowed us to adopt before the appeal was done. NO ONE thought the appeal would be vacated. SURPRISE it was! We have had the children for 4 years. My son came to us straight from the hospital. He has never spent a night away from either myself or my husband. This is devastating for our family. Someone told me that in Arizona you can not overturn an adoption after a year, is this correct? There is no mother, only the father now. We will(my attorney and I) take it back to court but was served papers to set aside the adoption. The 4 year old only knows his adoptive name. Everything has been legally changed. Anyone have info for me?Thanks

it is difficult to answer your question without more information. What was appealed? The termination or the adoption? If the termination was appealed than in most states that means they have to re-hear the termination case or build a case with better evidence. It does not mean that the children will automatically be removed and returned to thier biological parents. Personally I think it was in bad taste for the judge to allow an adoption when a known appeal was in process. That just sets up a situation for failure.
