Hi. We are in the process of getting 2 girls who are the children of a cousin and his wife. They abuse meth. Does anyone know how long they may have to complete their case plan before regaining custody? I have been reading that they may have about a year, then the children could be placed for adoption if they haven't successfully completed their case plan.
I think a lot will depend upon your area, the Judge, Case Workers over the case, and/or if this is the first time either bio has had CPS involvement.
In some areas if the bio parents are not doing anything they will expatiate the case, but most often bios are given chance after chance to get it together. From reading this site I often read about a 15 months cutoff, that the child(ren) will be in care for 15 of the last 22 months before TPR will be considered.
Unless the bio's relinquish their rights it is very probable that you are looking at at least two years from placement to adoption, if it goes that way, especially if this is the first time with CPS involvement.

They had the children removed in Sept. 2012 and were being given back some rights. They failed a drug test for meth two weeks ago and DFACS moved in and took them and placed them in an emergency foster home. So, this is bad for them I'm afraid. They hadn't even gotten all rights back yet & have now lost them "long term". We do pray they complete their case study. However, we have huge doubts.
