hi everyone,
we currently foster my wifes nephew. he went in to foster care at 4 months old. after 9 months he was reunified with his father (my wifes brother) for 3 weeks then removed again during a drug bust. the father had services terminated in March and we have a TPR hearing in July. Only since services were terminated has the father been trying to get his life together (job, living in halfway house, not missing visits etc) What are the chances he could get his son back or more time at the TPR hearing? The baby is now 2 and a half. He has supervised visits with his father once a week for 2 hours. I heard of the court dropping it to once a month but that didn't happen with our case. We have completed our home study. Thankd

It is very common for BP's to step it up as TPR gets close.
Courts are familiar wit that phenomenon.
This happened in our case, and right before the actual trial, my DD's BM imploded, thus ruining her chances to RU
I can't tell you what will happen in your case..
I suspect it would either be a postponement and renewal or services or a TPR.
I know this is nerve wracking. Hang in there!

Good luck. As I'm sure you know, every case is unique so there's no 100% answer out there. Courts are very familiar with this phenomenon. The fact that they tried to reunify and it failed miserably is major blow to the biofather's case. The fact that you are relatives is a major plus on your side because judge like to keep families together even if it's by the 2nd or 3rd degree. In the end, the biggest issue is that they tried with reunification and it didn't work. Unless there's something dramatically different this time around, the court will probably not be impressed. Rhetorically, apparently the biofather pulled it together enough to reunify the first time but somehow things went south rather soon, so what would make this time any different? Unfortunately, in the end, you'll just have to wait and see. :-( Judges have great latitude but they also weren't born yesterday. Good luck.
Thank you. I hope the judge sees through his BS. The only reason he is in a treatment program now is because he has an 8 year prison sentence over his head if he doesn't go.
