My husband and I became foster parents with intention of adopting. Last June a child came up that was legally free. Bio moms prental rights were terminated 15 months before.
We found out last Thursday that she won her appeal. Can the state appeal the decision? Now what?
Having to tell our FD was heartbreaking. The fear in her eyes at learning that she may go back to her mom was the worst thing ever.

In our State, the State can decided that the child can be returned to Foster Child status instead of adoptive. Depending on what Bios won on appeal, they may be given a new case plan, visitation restarted, or child could be returned home. However if the child is of age, FD should be able to speak w/ her lawyer regarding her concerns.
