I have been legally married to my spouse for one year now, together for more. I finally filed and my divorce was granted in 2013 and the Bio Father was told to complete a parenting class before he could see my daughter. He never completed this class and has had zero contact with my daughter since September 2013. He was paying child support via unemployment until December 2014. He is a user and has an unstable mentality but that would be word of mouth. He will not give up his rights to my daughter because he has an infatuation with me. Do I even stand a chance getting an attorney and trying to take his rights so my husband can adopt or will I have to wait many years?
the rules vary from state to state. in general, you need to file to have the BF's rights' terminated. In order to do this, you need to prove just cause (which varies from state to state).. typically, this will be abandonment.
you should speak to a "family practice" lawyer in your state to determine your options
