Hi, My son is almost 5 and I have not seen his Bio father since I was 5 1/2 mos Preg. I am getting married in may of 04 and my fiance wants to adopt my son..
I talked to 3 diff. atty's here in Sonoma County CA and they all said that I could file for abandonment but 9 times out of 10 the judge will deny it...
I could try to find his Bio father but he would do nothing bu hurt us.. I dont even know where he is....
Last time I herd from him he was calling me from jail and i was still pregnant.
I would be greatful for any and all success stories or SUGGESTIONS!!!!
thanks...

i have a 5 yr old son and i also have not seen the bio father since my son was about 2 mo old and now the child support agency is trying to find out who the bio father is...i told them that it could be multiple fathers so they would not find him. so now i have to do a blood test with my son and they already have the bio fathers sample. the bio father was insane and i had a restraining order againts him that was good for 3 years that ended back in 2001for domestic violence and slashing tires stocking me throwing rocks threw my window and the list goes on, he was caught and put in jail for 6 mo and was given the restraining order. but once the child support finds out that he is the bio father i am afraid he will have rights to my son and my fiance who has tooken care of my son since he was 6mo old wants to adopt him. he feel he is the father and we feel the bio father is no good for my son or is a good idea to be in his life. and we also are trying to find a way to get the bio father to give up his rights so my fiance can adopt him. my fiance is away in the military in louisianna and we are just as lost as you so if you get any information obout this subject please let me know. thanks so much.

I live Sacramento, I am trying to adopted my step daughter. I have a simular problem. There is a bio father and he hasn't even made contact with his daughter nearly 3 years and she is almost 4.
If all possible don't let the court decide. There is one avenue you could take. Have the father sign voluntarly to terminate his parental rights. As long as the document was not signed in distress the court will honor it.
I hope this helpsl.
