out of state uncontested adoption

we've started the process to have my hubby adopt my son. The birth father actually suggested it and has agreed to sign off on his legal rights. I just rec'd the paperwork from the county to get the process going, I should also let you all know we're doing this ourselves. My question is I got 2 forms for the birth father to release legal obligation...and one of them require a "clerk witness", my problem is that that birth father lives out of state, do i need to get a lawyer in his state to get the papers signed with a "clerk" witness?? just thought maybe someone knew. Thanks!
