Today, I was reading the Mercury (newspaper) on page A9, and the article is: Law limites withdrawal of Adoption Consent.
It talks of a story about a couple who's adoption fell thru due to a bmom changing her mind. They are waiting for court date once again to finalize another adoption.
As stated in the Mercury- " The waiting game will change under a new state law that places stricter limits on the time frame within which biological parents can change their minds about placing their children with adoptive parents. The measure signed by Gov. Ed Rendell on Weds., gives birth parents 30 days to withdraw their consent to an adoption. It will take effect near the end of May and apply to all adoptions initiated on or after the effective date".
PA does not currently impose a uniform deadline for revoking a bparents consent to an adoption. State laws currently allow bparents to change their minds about placing a child for adoption at any time before a court either terminateds their parental rights or issues an adoption decree.
This has been a main reason why adoption is so difficult in PA. Many have opted an out of state adoption, which is more costly or international. Hurray for PA !!!!!!!!!!!!!!!!!! :D
Hi-
That is great news for PA. After two failed adoptions in PA, that is why my husband and I chose to adopt internationally. We had two birthmothers change their minds. The first was after we had our baby boy in our home for almost a month from three days old. As you can imagine we were devistated. So, hopefully this new law will prevent others from going through the great heartache we did. We now have a beautiful 14mo. old boy from Russia!

Meli- Congrats!!! What a shame tho that you had to travel so far ! Pre our adoption, I researched time frames on bparents rights to change their minds.. found a few states that it was 48 hours... a few 5 days, then 10 days... funny tho.. that those states do not adverstise how short the time frame is.. ya know? I am glad PA is at least doing the 30 day thing ! woohoo.. bout time we come around to the year 2004 ! :) good luck with your son ! :)
It was a very long distance to say the least, but our son is so worth it. Can I ask where you adopted from and what states you found the shortest time frames for? Congrats on your adoption and good luck to you as well :o)
