We are going through an adoption agency in TX that was recommended to us by friends who live in PA. The agency has our application and we are just waiting to hear from them.
I was recently reading a listing from TX on an adoption hotline that stated they could not place in NJ. I don't know who to ask in NJ regarding this. It could be just that agency but I don't want to try to bring our baby home and have NJ refuse the adoption because of a legal issue. Does anyone know anything about this?
Any information regarding this would be greatly appreciated.

I adopted my second daughter from Texas when I lived in New Jersey - I used a NJ agency for home study and follow up visits, a NJ attorney for finalization and I found the wonderful birthmother through advertising. I had an agency in Texas to handle the relinquishment and placement agreement and they officially oversaw the adoption placement until finalization.
Was the listing you saw from a faciliator - you are not allowed to use them if you live in New Jersey no matter what state they are in.

Keep in mind also that Texas is one of only a few states who allow non-residents to finalize under their laws. We live in Virginia, our son was born in Texas. We chose to finalize in Texas vs. Virginia primarily because the costs were somewhat (though not dramatically) less, even with a return trip to appear in court for finalization.

I do have another concern. Am I required to retain an attorney in NJ even if I'm going through an agency in TX and the home study prepared by a NJ licensed social worker? I'm assuming that the legal matters will be handled by the agency in TX and through NJ when the time comes to bring the child home. Regina, you mentioned that TX laws will suffice no matter what state? Does this mean that I don't need to retain an attorney?
