My mother and i are in a legal crisis we know nothing about. Here is what my mother wrote. Maybe someone can help:
My ex-husband left my sixteen year old son with his second wife when he left the state of Colorado. She has since filed for divorce and parental gaurdianship of our sixteen year old son. She has no legal custody that i or my ex-husband are aware of. He has custody in the state of Colorado, but is no longer living there. I had custody in Texas before he took custody in Colorado. What are my rights as the biological mother since the father is not residing in the same household or state as my son? Can she take custody without my knowledge or permission?
If anyone can help us, please let us know. We are blindfolded in this matter

If she doesnt have legal custody or guardianship, them mom can drive to Colorado and pick up her son without incident, provided she has legal custody paperwork (from any state) saying she has legal custody.
I have a hard time answering the other question regarding guardianship without it sounding rude, so forgive me.
Why was their minor child been abandoned in Colorado without a legal parent?
Any judge is going to wonder whatҒs going on, and act in the best interest of the child.
Look at it this way, if something where to happen to the child today, say, he is involved in an auto accident. He has no legal guardian or parent who can consent to treatment for him
If mom wants to exercise her custody rights, then go for it. If she doesnŒt, then the best thing for the child would be to allow step-mom legal guardianship, at least in my opinion.
