Step Parent Custody

My husband would like to do a step-parent adoption of my 5 year old son. The biological parent is willing to sign a no contest form. Although my husband is an Australian citizen, we were married in the U.S. February 14, 2003. Is there a waiting period that we have to endure prior to my husband seeking a step-parent adoption. I would like to proceed befor the biological parent changes his mind?

You dont have to be a citizen of the United States to adopt, but you do have to be a legal resident.

Each state has a requirement as to the length of marriage required before you can adopt, generally the requirement is two years of marriage.
