Appeal

We go to court tomorrow. My attorney told me that because we agreed to things the BF will have his rights terminated by default. After the rights are terminated he will have 60 days to appeal. He is requesting that he receive a picture of the children at court. I told our attorney that I am not happy about that because I am worried that once he sees that picture he will not want to go threw with it. He is not going to be in court, so it will run into the appeal time once he gets the picture. Can anyone tell me how appeals work and if I should be worried. I have always had such bad luck with family courts and I want to rest easy during the next 60 days!

I heard appeals are rarely overturned. You probably have nothing to worry about. It still not family court anyway right? This trouble in family court you speak about, are you willing to share about it. I am going through trouble in family court too and am being very patient on the adoption matter, hoping that his rights will be terminated despite the sympathy that he gets from family law. My understanding is that the appeal is a pain and takes longer but it will still go through. If you give him the picture he may appeal but if you do not give him the picture he can still appeal out of spite so either way he could appeal. Maybe he just wants something to remind him of the children he use to have, besides he doesnt have any pictures himself. If thats the case I can see why his rights would be terminated. Just relax I am sure everthing will work out well.

I think there would be a greater chance of him trying to appeal by not seeing a picture. By not getting the picture his fears of never seeing the child again will definitely be more prominent than if he isnt given a picture. If I were in your situation I'd give a couple pictures. Good pictures, not fuzzy. And I'd give a photo of myself, hubby and baby together if at all possible. By giving the pics and maybe a little letter of reassurance, I think would save him from worrying. JMO.
