Hello My wife and I live in Calgary and we are starting on a long road to bring a little 4 year old girl over to Canada.I'm looking for any experiences with relative adoptions at the 5th degree consanguiauity. our child is also quite sick with weak lungs so if any one has information on dealing with sick children and adoptions then we would be very greatful of the information. We are from Vancouver BC .Our experience with Philippines Adoption has been the most horrific. We found that our relative child adoption application was held up by the social worker conducting the child study report with no specific reasons. This social worker do not even make any attempt to discuss with us nor with our family representative in the Philippines.The strangest of all is that ICAB suggested us to take the inter country adoption route for our relative adoption and it has beem well over seven months since we have submitted all the necessary documentation, there seems to be no reply from them. What we have experienced from the Philippines is that their social working system is for the family in need to beg for their help rather than they are the one taking the initiative to investigate as whta is expected from the social working profession.We are very appaul in having to deal with those kind of nonsense in the Philippines.

In your case if your child is very sick with lung, we suggest that it is for your best interest to talk to ICAB directly and ask for their advice and for any recommendation from them in speeding up your application.ICAB is willing to give consideration up o 4th degreee of sanguinity. You may ask ICAB for further assistance in your case.For the case of your child health condition, the Canadian Embassy in the Philippines may not allow the child to leave the Philippines.If the Canadian Embassy rejected you, toast the Liberal !
Thanks for your replyWe have decided that we might try to play up the health problems to DSWD but play it down a bit to ICAB and Canada immigration. With help from this forum we are starting to build a bit of a game plan. The whole thing with adoptions it seems is not to miss any steps or try and say the right things at the right time. Try to play low to the DSWD as well.Since the child study report is conducted by the DSWD to be submitted to ICAB, ICAB will base their decision on the information in the child study report prepared by the social worker from the local DSWD.Do not overly excited them.
It is so unfortunate that politics and red tapes often act in detriment to the best interest of both the adoptee and the adoptive parents.We hope that you will not run into a situation like us where our adoption application is being put on hold because we refuse to play under the table.We will not disclose the parties involved but we do not mind sharing this dark side from the Philippines adoption.
I understand with the steps to be:
1. The petition for adoption is filed by the adoptive parent(s) representative alleging the petitioners are qualified to adopt and the child is qualified for adoption.
2. The RTC (Regional Trial Court having jurisdiction over the child) orders the child study and petitioners evidence which is to be submitted to the court based on the court calendar.
3. The child study is conducted by the DSWD office having jurisdiction over the child. This is where the social welfare worker resource (person) is located. The DSWD office has until the court calendar date to submit and appear at the hearing to provide testimony. If for some valid reason the DSWD office cannot provide the child study at the ordered time, they must submit a motion to reschedule the hearing. The DSWD can provide a partial child study during the hearing but must comply with the court order. A representative from the OSG office must be present.
The same is true for the adoptive parent(s) representative; they must submit and give testimony about the qualifying evidence submitted.
Having gone over the process at this stage, how can the child study be held up? I think the only way this can happen is if the is a bio-parent is not available and they have parental rights over the child. (Example: out of the country.) The court will hold the DSWD representative in contempt for not obeying the court order.
If your case is being help up? The usual suspects are not ICAB and the DSWD but rather your representative claiming that the process is at a particular stage. This is a corrupt Lawyer tactic to get you to believe the process is moving along and hit a (I want money stage, pointing the finger at someone) when in fact the Lawyer has submitted nothing. A person claiming to be a DSWD representative stands in as a dummy.
My wife and I found that the DSWD is the right place to be visible and tell your story. They are the front-runners for the children and are the people that can make things happen for you and the child.
Be sure the people you are introduced are who they say they are. This is a classic Filipino con. My wife and I struggled for a year with our first Lawyer. When we finally came around to knowing the tactics, we started following every step in the process, even if it meant walking a receipt across the street.

This is what Dr.L from ICAB suggest us to take the Inter Country Adoption Route for our relative adoption to save cost on taking further local court proceedings and lawyers fees because ICAB will follow the procedure when our adoption case is handed over top them. Dr.L knew about that we were following the local court procedure for our relative adoption and this is what she suggested, the inter country adoption route for our relative adoption to bring the child to Canada.This is what they suggest and we follow their suggestion.
