we have been contacted by a birth mom who wants us to adopt her newborn we have been told that we can not do this with out an agency and that the agencys may not even place the baby with us can some one help us on this Thanks
I'm guessing you don't have a homestudy in place yet? If so, than one will be needed.
Since I'm not familiar with your state's laws, I'd recommend you get in touch with an attorney experienced in domestic parental placement (aka private) adoption. The American Academy of Adoption Attorneys keeps its' member list online at [url]www.adoptionattorneys.com[/url]. Contact a few in your local area. Ask them about what your states' laws are regarding parental placement, etc. Also ask for their fees and services, experience in domestic parental placement, etc. You will definitely need an attorney.
Most agencies when faced with a 'directed' placement - where expectant and prospective adoptive parents come already identified - honor that agreement. They must, for they cannot 'take' this child from it's biological parents and place it with whomever they want unless that's what the biological parents ask them to do (it's called an 'agency placement')
I'd also recommend you head to your local library or bookstore and read everything you can on domestic adoption. Some good books:
