We adopted an 11 year old now 15 who has required out-of-home placement (returned to state care and custody to effect issuance of services for a child who was a danger to self and others) for 2-1/2 years ... originally we had assumed tpr would occur at 15 months in care per the Safe Families Act if things couldn't be resolved but now understand that due to his age he can be classified "independent living" and DSS is no longer requiredto process tpr ... and the parents are not allowed to request same - it must come from DSS or the child's attorney.
As the recommendation is for the child to not return home by the residential treatment center and the child participates in no communication with the parents, why wouldn't tpr occur - while we know re-adoption at 15 is a big question but never say never ... and why hold him to a family he does not want ...?
Anyone have any information as to how to get tpr on a situation of this nature?
