My wife, who is from Brazil, and I are considering me adopting her 10 year old son, who was born and raised in Brazil until 10. The biological father is also Brazilian and still lives there. During his years in Brazil my step-son was raised exclusively by his mother and maternal grandparents. Does anyone have any experience with such a situation when the step child is from another country? Is the biological father considered absent, or do we still need to get his permission? We are citizens of the state of California, and my step-son is living in the US on a family based immigration visa.

First of all does the father appears on the birth certificate?..if not and the mother has all legal rights in Brazil for her child, you can do it, as long as there has been no contact over 3 years minimun between the father and the kid, then he has legally give up his right has a father, and she doesn't have to recieved child support from him, than you can do it, just contact the office of Steparent adoption unit you fill out the form go to court and a social worker will go to visit you and she will present a report to the court saying her point of view refering the adoption. BUT you must have around 800 dollars for the process.
