As per request by Immigration for more supporting documentation in our I-600 Petition for my wife's niece.....BCIS requested that we get a "Deed of Voluntary Committment" from The Department of Social Welfare in the Philippines. What the heck is a "Deed of Voluntary Commitment?" This term is not to be found in the glossary on the BCIS website, nor can I find it anywhere else.....any ideas would be helpful. Thanks in advance.
The term is not one created by the USCIS. The USCIS is simply asking for the Philippine document that shows that the child you are proposing to adopt was legally relinquished. Every country has its own legal procedures for relinquishment and adoption.

When a child is being "qualified" as an orphan the court will look for the Deed of voluntary commitmentӔ before the decree of abandonment is issued.Ӕ this is what qualifies the child for the Intercountry adoption program under ICABs rules. Your lawyer would have provided this document for parent(s) to sign and include in your petition if itҒs done through the RTC. Your Lawyer should have this document in your case file. If he does not have a copy youll need to get a certified copy from the court clerk.
If everything is being done through ICAB and not directly with the RTC then IҒm not sure of the exact procedure but I would guess to meet the legal requirement it would need to be obtained by the social worker before the child is qualified for the Intercountry program. If this is the case then you may get a copy of the document through ICAB.
You may also have heard the document termed "consent of the natural parent."

however, this is NOT an agency adoption. It is an adoption within the family. No agencies are involved. We have just learned that the Dept. of Social Welfare will NOT issue such a document, because it will transfer the child out of my sister in law's home into an orphanage. This is opposed by both our attorney and the DSW social worker, and is totally unacceptable to us. The ICAB is only in Manila, and as far as I understand, only handles agency adoptions. Exclusions are made for inter family adoptions, which make going through the ICAB unnecessary. This adoption is filed in a provincial court 300 miles south of Manila. A "consent of the natural parents" was included in our original court transcripts which were given to BCIS. My opinion is that BCIS is making this unnecessarily difficult, and I've contacted my Congressman.
