When can we can claim an Adoption Tax Credit for a failed adoption that occurred in 2006? On our 2006 return or our 2007 return?
I have searched previous related topics and waded through a lot of conflicting and sometimes just plain wrong information. I am looking for a solid answer from someone who knows for sure.

Well we adopted a child in June 06 and in October 06 the mother took her child back. I filed my taxes this year for 06 and did claim the ADoption Credit. I did receive the adoption credit with no problem. The one thing i did learn is that if you don't have the SSN or Adoption Child ID (you should apply w/ the IRs ASAP when you adopt a child) you can't do E-file. That doesn't mean they won't pay you, your tax preparer will just have to send supporting docs. (Receipts from agency/lawyer and proof the child was in your home). If you e-file you can get your taxes back in a week and 1/2; but if you mail in then it was taking up to 4 weeks back in Feb. when we did ours.

We used our failed adoption info from the year it failed. So, if it failed in 06, you use for that year. You will need to send info about the agency or the attorney and your receipts. We lost thousands and it was a help to us financially, just wish it would help emotionally. It is true you will have to send in and not efile. Hope this helps you.

If you have the Adoption Child ID or SSN you can E-file, but those are the only ways you can.
