We received our court paper from our lawyer that stated we had a court hearing on 6/6/07 at 2:30.
When we arrived the security guard informed us that it could not be because the appeals court holds their hearings in the morning.
He checked and confirmed that it was at 10:00am.I checked the sign in sheet and seen where our lawyer had signed in at 9:31 and signed out at 11:00 am.
My wife being very angry when talking to the attorney well lets just say we don't know much other then the Bfather or no one from NC showed up and that the 3 judges told our attorney that they want us to win but they must follow the law.When they will give their ruling we do not know.
I will be calling the lawyer so that I can get the info we need and will post more then.

I'm sorry you missed the hearing-I know you probably wanted the opportunity to address the judges directly. But I'm glad the birthfather & his attorney didn't show up. It says a lot to the judges about his commitment (well, lack of) to gain custody.
I hope you hear good news soon.

Oh my Gosh I cannot believe you missed the hearing. Thank God the birth father did not show. I will tell you this with our case, the judge did say we must follow the rules because too many times years later with these cases the birth father will come back. At that time I was furious because to us it was just saying to give him more chances. This same judge granted our adoption after 2 years. She told us, he had enough time and thank God she moved forward with the adoption. Hang on, I strongly feel you will have peace soon....

Is it possible that the bfather was also told the wrong time for the court hearing? Have you determined how this happened, that you were told the wrong time? Was it your attorney's error or a court error?[/FONT]
Well I left the attorney a message:
Hi attorney How are you today.
I need you to call me at ***when you get a chance.
Right Christie?LOL
He called me back and stated that the appeals court notified NC and Bfather and attorney the correct time and place and they did not respond.
I asked him if that helps us and he said yes but with jurisdiction it will probably make no difference.
To me that is saying: The bfather and his attorney or anyone from NC has never stepped foot in a court room to argue their case or never even filed any briefs regarding this case, BUT yet they are still winning.Makes no sense to me!!They did the same thing in the lower court and won.
I asked him if it hurt us for not showing and he said not at all that is why you hired me.I told him we still would have liked to be there and he apoligized for his secretary's mistake.
He said he is working on a few other avenues but could not get into detail because he was in court and that we could be waiting for their decision from 2 wks to 2 mths.
SO we wait and pray and hope for anything that would indicate that someone somewhere will consider the wishes of my (next month) 9yr old daughter.

Thanks for updating us, Daddy's Angel. It sounds quite positive in terms of a birthfather who doesn't care to show up. Your mistake was "secretary created". His was intentional. It shows no interest in what happens to this child. I also feel you will have peace very soon. Hang in there. What a strong Daddy you are!!!!!!!!!!!!!!

Yeah, daddysangel, I am working on that. I have decided not to call my lawyer at all if I can't leave at least a neutral message. You are right that my nasty ones to him don't get me anywhere.:hissy:

daddysangel - I will just never understand that. Not show up and still win??? I love what your lawyer told them that one time about he had no idea how the other side could just not even put in an appearance and still win.

...we could be waiting for their decision from 2 wks to 2 mths.
And I am waiting with you. Please let us know as soon as you hear. I am praying for wisdom for the judges, and that they will put your daughter first.
