I was posting to get some info about my husband adopting my daughter. We were married three weeks after she was born. He is not the biological father. My daughter is one and we have been trying to get the adoption process started but it just has not been possible. I want to know how long we have to be in the state of texas to be able to start the adoption process?
6 months. You can't start the adoption process until the child has lived with the step-parent AND in the state for 6 months. At that point you can contact a lawyer/do research to decide how you want to proceed. I have been researching for the last year and am about to start on my daughter's adoption (We had to wait for the wedding and 6 month waiting period). Start by getting the biological father's rights terminated. Once this is done its pretty easy. Ya'll will have to have a home study, background (as well as anyone over the age of 14 living with you), and (ironically) a Dr's note.
