Ok it's been to long and I don't remember (quickly finding I really remember NOTHING about when we brought DD home such as how much STUFF she had, anyways different topic). Baby boy is due in 5 WEEKS and we just found out Friday night that they are placing (this is my DDs bio brother) and placing with us. Anyways we are in a scramble to file our taxes because this baby is unplanned (for biomom as well as us same with DD LOL) so we did not have the money laying around. I have contacted several attorneys and stuff but won't talk with them and meet them until this week to pick one.
With the tax credit since baby boy will be born around Feb 17th if we are final this year can we amend our taxes and claim the credit? We had some stuff planned that we do need that tax return for which includes paying down some debt which would allow me to stay home more. Anyways, I would hope we would be final this year however with DD they took forever.
I'm not sure I understand your question, but I'll take a stab at it.
The taxes you are filing right now are your 2009 taxes.
The new baby is due in 2010, and with a Feb due date you are likely to also finalize in 2010, and you can claim all your expenses under the adoption tax credit on your 2010 taxes.
There would therefore be no need to amend any year's taxes - everything would already be filed on the proper year's tax forms.

No what I was asking is if I could ammend them to go ahead and get the tax credit back pretty much right away. We were going to use that money to pay some stuff down and off so I could drop a few more hours at work.
You're asking if you can amend your 2009 taxes for an adoption that won't happen until 2010? If that's what you're asking, the answer is "no".
