I was reading on the internet for CA AAP subsidy's and found out that any adoption finalized after 1/1/10 is now classified as tier III and NOT eligible for age payment increases. I hope this has already been reversed, but fear not.
Does anyone with any knowlege about this know? I can't imagine how detrimental this would be for people adopting from now on.

I do know that California looks at their own state's rates and the receiving state's rates. They pay whichever rate is higher. This is if the child is in California, and still applies if they are placed out of state. If the child is coming to California from another state, then it is the sending state's policy you will need to research.

anyone know how you get the increase? I was told we'd get it but I thought I read somewhere that you have to put in the request each time the age gets into the higher bracket. I wouldn't even know where to call to have that done....anyone know?

My understanding based on what I was told by my caseworker is that just about all children adopted through foster care in California are considered "special needs". This is because California considers "Adverse Parental Background" as a special need and almost all foster children have an adverse parental background (or else they wouldn't be in foster care). This means they automatically qualify for the basic subsidy and the full federal adoption tax credit.
What the caseworker told me appears to be accurate because I just completed the adoption of my daughter and I will be receiving the basic subsidy (around $400 per month). She is a healthy, caucasian, 7-month old placed with me at birth so she doesn't qualify as "special needs" other than "adverse parental background".

I am bringing this to the top (I know it's a super old thread) because we will be finalizing the adoption of our little guy in a few months. Anyone know if ALL kids adopted through the system qualify? Just curious if anything has changed. My guy's mom relinquished from the get go, so it's a unique situation. But, we still receive the basic foster care rate.

It's at least exciting to be talking about aap with DH, because it means we are getting close to finalization! :cheer:

The SW did tell me we were eligible for the $400 non-recurring reimbursment, so hoping he qualifies for the aap too.

Your adoption CW would know because when you sign the paperwork to get the adoption rolling, you are presented with the AAP paperwork at the same time.
I think the base rate is $446.
Definitely hire a private attorney. I think the last lawyer I hired in 2009 was $425. So the lawyers do try to keep the price close to the amount of the non-recurring reimbursement.
