We would like to pursue an international adoption. This is not possible for us from the US side, since we are not US citizens. Does anyone know if there is a way that we can do this - is there a way we can adopt under the Australian law, even though we don't live there - essentially, do we have to be living in Australia right now? You can adopt from overseas but I suggest you contact the Aust Embassy near you and speak with the First Secretary for Immigration. Provided you have followed the laws for legal adoption from whatever country you choose then the only other concern is to ensure that the child has no long term illness as a visa will not be granted. While you remain overseas it is best to gain an adoption visa for the child (so that you can travel to Oz) and when you finally return to Oz for good then apply for ctizenship for the child.

Hi Jane - thanks for your comment. The problem as I understand it is that the US won't issue a visa for the child to live here unless the child has lived with you for 2 years. So it is ok from the Australian end, but getting the US visa is supposed to be a problem. If you know how to address this, I would be glad to hear. Thanks.
