Legal to be matched before approved home study?

Hello! My husband and I are in the process of our home study. The agency we're planning on using for the actual adoption (different one than the one for the home study) apparently matches adoptive parents with birthmothers even before they're homestudy-approved. Is this legal? We need advice. Thanks!:confused:
