I checked the status of my anticipated 2010 tax refund online today. I found out that the IRS is sending me a letter asking for more information. Upon checking my records, I discovered that I did not attach the copy of the adoption decree to form 8839. I assume that this is what the IRS will ask for. Should I operate under that assumption and just send the IRS a copy of the decree and itemized expenses from PSBI (our adoption agency) or should I wait for their letter? If the former, where should I send the documentation and how do I reference the tax return? Do you think this will significantly delay our refund? Should I wait to hear from my accountant? Any advice is appreciate
Do a search of "Adoption tax credit" and read the the 3 threads by people who have been through this. Lots of info.

You need to wait for the letter because it will give the specific location you need to send or fax the information to.
I sent in my IRS retrun with the required documentation and later got a letter stating they needed the Adoption Cetificate of Finalization, which I had already sent. I sent receipts from lawyers, airline tickets, etc and then the next letter sais I had a penalty of $2500 (20% of the credit amount!). How dare you to try to take a credit...we will punish you!! I called and talked the the IRS (a 25 minute wait period) and the lady informed me they DO NOT forward documentation to the other offices......surpise, surpise!! I had to send another copy of the Certificate of Finalization plus another copy of the lawyer fees, etc. Hopefully this will complete the process. Why do they ask to send a copy of paperwork they plan on throwing away anyway? ARGHH!!
