Here is the short version of my story! baby B was placed with me when he was 2 days old and bio parents dont go to court again until Sept 26, 2011 since July 7's court date
they have not done one single thing they are suppose to and they constently missed visits. what are the chances that baby will get returned to them and what should I expect when they go to court in Sept.
It's too early in the case.They will get another 3 months. American Safe Families Act says if the child has been out of the home for 15 out of 22 months then the case can be moved to TPR. They have to have enough evidence to warrant that.
Hang on. Remember the point of foster care is reunification. If this little one is meant to be yours, he will stay. If he doesn't, there is another little one out there that is either not here yet or doesn't need help yet.

Thanks for responding! I know that the main focus is for the baby to be back with mom and dad but it rips my heart out that they are just blowing baby off like he is nothing. I guess it makes it harder that they are family and i know everything that is going on. They will look me in the face and lie to me. And the mom has already lost 4 children to the state. I want so bad for them to be involved with baby and they just dont show no interest. I will keep you updated on progress.
I believe the law is they are required to file TPR when they reach 15 of 22 month mark.. but they CAN do it at 6 months . all depends on the case.
It doesnt have to be 15 of the 22 month rule thing. We got our first placement in April2010 and finalized adoption in June 2011, thats 14 months from removal to adoption. We had TPR in Sept, just 5 months after removal! :) We had two visits in that time, but bmom was involved in some DV stuff and the bdad of one of the boys was doing drugs, but the did TPR all 3 parents (different dad's of brothers)
Well since I last posted, I have talked with fcw and she stated that she is not recommending the baby go home since the bp got evicted out of their home and moved in with his brother who has a very thick folder with cps. bm refuses to do drug test and counseling and bd refuses to do his phyc evalu. they cont. to miss at least 1 out of 3 visits a week. Its a real mess over her just wish they would get their act together. they go to court end of month i'll keep you updated.

UPDATE:
Well we went to court and it did not go well for bio parents at all mom tested postive for drugs every drug test she had during the last three months and the dad did not do a single thing he was suppose to> Jugde told them they have 60 days to get what they needed to get done other wise he was going to start TPR. so now we wait till November 28th and see what happens
As far as safety for the child is concerned, I'm glad to hear the judge was in favor of that. That's a relief. Sorry to hear about the family being willing to lie to you, I guess some people it's almost a reflex, you know? Tiring to deal with, for sure.
Are you willing to adopt if it comes to that option, is that something you're considering?

Yes i have thought about it and its an option for sure just not going to get my hopes up its already going to be hard enough to return to parents if thats what the state decide to do.
Update,
Both parents signed off today on baby. We are going to be his forever parents. This is going to be the best Thanksgiving ever. life is good. and because his has already been with me for 6mths it should be final quickly.

As of April 5th, 2012 the adoption is final he is all ours now!:dance:
Congratulations on your adoption! Glad the child (and you) did not have to ride too long of a roller coaster waiting for permanency!
