Can someone tell me how to file to be a party the the case for my foster kids. We have had them for 6 months(will be in two days), parents have an lawyer and at every court hearing we are asked to leave the courtroom since we are not a party to the case. Is there a paper to fill out, do we have to petition the court and get approval from the judge???
I asked the caseworker after court and she said she didn't know.................

That doesn't make any sense. I was told that fosterparents are ALWAYS party to the case. I attend court fairly often even family hasnt' asked. You have to be invited to a family team meeting but not court. Who tells you that you have to leave?
Do you have a CASA or GAL? I would contact them and/or possible DCS attorney. There are certain hearings that are private but most aren't. What county are you in?

The parents have an attrny and as soon as everyone sits down he asks the judge to have everyone leave who is not a party. The first time this happened the GAL told the judge that we were the fp and he said it didn't matter we still had to leave. CW told us from the beginning that we should be allowed to be in there as we are a party since we have placement of the kids, but every time we are told to leave. So we wait out in hallway and then cw and gal come out and tell us the jist of what happened and we leave. We want to be heard, we want it to be known we are there. The whole case is one of the craziest we have ever heard of. The CW is coming out next wed. so hopefully she will find out something for us.

We hired an attorney and petitioned the court to become a party to the case. It was definitely the best thing we could have done. Our attorney is experienced in this area of the law.
