I've heard conflicting info about this.
We paid our agency fee in 2010. I am told that we can claim this on our 2011 taxes.
My accountant (who admittedly is a real estate accountant) said he thought that in order to claim the ATC, you had to have had a finalization. But, according to [URL="http://www.irs.gov/pub/irs-pdf/i8839.pdf"]http://www.irs.gov/pub/irs-pdf/i8839.pdf[/URL], there is provision for claiming the ATC for "Domestic adoptions that have not been finalized."
And, by using form w-7a, we can apply for an Adoption Taxpayer Identification Number in lieu of a SSN.
So, I'd love to hear if you've filed without a placement, how much time did it take for your refund and what additional information were you asked to provide.

Yes, claim your 2010 agency fee on your 2011 taxes.
But don't use an ATIN. Just put the agency's or lawyer's information on the line that asks for the child's name and SS number.
And of course remember to:
1 - attach the required documents (all of the required documents and nothing else),
2 - send it snail mail (not e-filing), and
3 - keep copies of everything that you send.
The IRS *WILL* ask you to send the required documentation again - they don't forward the attached documents when they forward your tax form to the department that deals with the adoption tax credit. (Stupid of them, but be prepared for a slew of letters that sometimes contradict each other, a request for at least one additional set of the same documents that you already provided, and a lot of waiting. Just keep waiting, it does work out and you will get your refund, it just takes time. Don't stress.)
People who filed back in Jan-April were reporting anywhere from zero to four months of delays in their refunds.
