We are trying to decide on an agency and country program. We've been getting some conflicting information about marriage length requirements for China. My husband and I are both widowed and have been married 2.5 years. No divorces in our past.
We have read several places that the marriage must be at least two years, unless there was a previous divorce in which case the requirement is five years. We were told by an agency that the requirement is five years if there were any previous marriages, even if they ended in widowhood.
We are interested in adopting a child between 3-5 years old. We have an 8yo from my husband's first marriage. We are open to either gender, and are open to certain kinds of special needs (e.g., non-DD cerebral palsy, limb differences, etc.).
Is there a chance China would make an exception on marriage length in our case, for a SN adoption? What resources could I go to for a definitive answer?

I would be more concern, about how many years you have to wait, before you get your child. It seems like you wait for ever,if your adopting from China.

The agencies that specialize in China adoption will be your best resource for this question. I know of several people who adopted via the SN program but not sure if they had any of the "typical" requirements waived. I will ask one I know and see what they say.:)
Have you called more than the one agency? I'd try a few and see if the answer is consistent.
A friend replied to my question and said they do waive things at times for the SN program. Said you should ask the agency to ask the CCCWA.

it does not cost anything to call other agencies and see how they interpret that rule. and yes, China does grant waivers for marriage length, age of parents (for those over 50, but never for under 30), etc.

If you are planning to adopt a child through the Special Focus Program, then China may give you a waiver. I am a member of a Yahoo group for waiting children in China, and several members have received waivers for age, length of marriage, number of children at home, etc. From what I have seen on the group, I think that the CCCWA is very reasonable regarding waivers. Some agencies will not ask for waivers, others are really good getting waivers from the CCWA. Make sure that you clarify with a prospective agency what their experience with getting waivers is. Also, it could not hurt to join an online forum for China adoption and post a question about waiver policies.
