The father of my child and I have never been married. We have a 4 year old daughter that is turning 5 in a few months. There has been no court ordered child support or visitation set for these past 4 years. The father and I have not been together since a little before I gave birth to my daughter in 2009. He was still in her life until May of 2011.
In June of 2011 he stated that he wants to cut all ties completely and not see his daughter or pay any support. I agreed since my current husband now was the one that was supporting and caring for her all these years.
Recently, the father decided he wants to come back into her life after being absent for almost 2 years. My husband and I have already filed for an intrafamily adoption case with our attorney/lawyer, but since my daughter is on medicaid, the state of Louisiana has created a case to get child support from my daughter's father and the court date set for the child support case is 2 weeks before our adoption case which pretty much states he has been out of my daughter's life for over 6 months.
He has recently within the past 2 months tried to squeeze his way back into her life just because medicaid served him wit child support papers. I don't think it's fair that he can leave her life when he wants and come back when he wants. It's hurting her more than it is anyone else and it confuses her.
What are the chances that we will be able to have my husband adopt my daughter in our favor and terminate the father's rights?
