So for 2003 for this adoption alone we would have a tax credit of $30,000 correct (3 children x $10,000)? Since we do NOT make more than $150,000, then we would be eligable for the enitre amount, but also would NOT be able to use the whole amount in one year as out taxes would not be that high. So my understanding is then we would be able to carry over the credit to following years? If so how many years can it be carried? And should Congress pass the bill to make the $10,000 special needs & no qualifing expense clause retro-active to 2002, we would also have $30,000 fed tax credit from that year too (again 3 x 10,000).. so what effect would the over lap have? Also when you talk about the tax amounts is that before or after the addition child tax credit (line 48 of the 2001 1040 form)? (i.e. are we looking at line 42 or line 52 of Form 1040 on the 2001 form?)Sorry this is so long and complicated.. but that's how most things in our lives are right now.. Even though we are adopting overseas, it is still considered a special needs adoption in Missouri per their definition of special needs children. First off, let me tell you that the Missouri state adoption tax credit is $10,000 per child. You can carry this forward for four years. I DO KNOW that you are allowed to "assign", sell, or transfer your credits to other Missouri taxpayers. This could be a HUGE help to you in attempting to get your entire credit back quickly. What this means is that you can give or "assign" a portion of your $10,000 tax credit to perhaps your parents, or your siblings, or neighbor, or friends, etc. and let them "have" the credit. In practice, what you could do is tell everyone you know and who you would think would be willing to do this for you, that you are adopting and you need a favor. What would happen is that while they are filling out their tax returns, they let you know their total tax liability for MO the previous year. You can then "assign" a portion of your credit equal to their tax liability to them. You have to fill out some form that says you agree to this, they enter it into their tax return, then they send it in. They will now get your credit, and turn around and write you a check for that amount once they have received their refund check. Voila! You have just gotten your credit much quicker. Obviously, you would have to do this with people you trust and who wouldn't then just keep the money, because they technically wouldn't have any obligation to give it to you since you just signed a paper saying that you are handing over your credits to them. I believe the reason they do this is to make it easier for you to obtain loans from your friends and family for adoptions knowing that all they have to do is to get you to sign over your credits to them and they'll actually get their money back from the government. You can go to the Missouri Department of Revenue's website to find further information. Their address is Also, if you haven't already, since your situation is so unique, I would STRONGLY recommend you hire an accountant for your upcoming tax return that specializes in adoption. I do have a name and phone number of a CPA in St. Louis that is supposed to specialize in adoption and also knows not only how to "assign" your credits, but she can also somehow "sell" your credits. I personally do not know her and have never used her services, but I did get her name from someone who highly recommended her and I intend to use her services this year. Hi. I would love to get information on the St. Louis CPA that you have information on. We are in SE Missouri and our local CPAs don't think that this is allowed and so I am provng to them that is allowed. But I am thinking that we just go to a reputable accountant in St. Louis as we did 2 adoptions this year and would like to assign the credit. Can somebody point me to where I can view the definition of "special needs" in Missouri? Also... regarding the tax credit, I read just today that CORPORATIONS buy the tax credit from individuals and basically "use up" the entire $2 million credit available within a few weeks of it becoming available. Has anybody had their credit denied? I would hate to sell my credit to a corporation and become part of the problem but if that's the only way I'm going to get a credit next year...???
Anyone have this experience?
