I have a three month old daughter, by a very mentally and verbally abusive man, he is not mentally stable, and his own family will attest to that. He never physicvally laid a hand on me, but he did threaten my life and the life of my daughter while I was pregnant. I did not name him as the father on the birth certificate, but the state is pushing for a paternity test because I was recieving aid at the time of her birth, but am no longer. I've tried every thing i know of to do to try to have the court order stopped including trying to have the amount that they're wanting paid back to the state made payable by me, but to no avail. during my pregnancy and since the birth I have been living with the most wonderful man in the world, who would like to adopt my daughter in the near future, but in the mean time I need a direction as to what to do about the biological, i fear to even have the paternity test done because I don't want him to be able to petition for parental rights, the thought scares me, he shouldn't be allowed around children, he's abusive enough to the child he has in his care....does anyone know of anything I can do to stop the current order, and try to avoid establishing parental rights so that in the future I can keep from disrupting my daughters stable life???

You are right about not establishing paternity if you can help it. If I were you I would seek out a lawyer.

Yes, get a lawyer. Maybe you can petition for a stepparent adoption now. But bear in mind that once paternity is established through a stepparent adoption, there is the possibility of the state coming after you and your husband for the money owed.
