My husband and I have been married since September and he wants to adopt my son. My son just turned 3 yo and has had no contact with his bio father since he was 2 weeks old. His bio father is currently paying arrears on child support, the child support order was stopped because he agreed to sign over all his rights when my husband and I got married. However when I contacted him in January (we were still living in Pa at the time) he said he didn't know anymore and would call me back, and I haven't heard from him since. I know there is some kind of law about one year in California and I was wondering what that was for. My husband is AD Military and I was wondering if the rule would still apply to us. The child support order was stopped almost 2 years ago. However he pays $100.00 a month on his arrears. Does this have any affect on the adoption. Can someone please tell me the options I have and where to go about to do everything. TIA!

No consent was signed but it is written in the child support order from Pa that I was stopping the child support because he agreed to sign the papers when I get married. They say it doesn't hold much credit though because it is only a support order.
Speak with your attorney on that one. He agreed to that in court and he has not had contact with the child. You've got a good case. Please look at the posts I have about the adoption links. There are links that will direct you to California Law and you can look up abandonment.

We dont' have a lawyer we would be going through base legal. And when the paper was signed it wasn't signed by a judge it was only signed by a mediator I didn't know if that had anything to do with it either. Back in Pa they said it wouldn't hold up in court because it wasn't a legal document.
