Has anyone here ever been provided with a copy of their state agency homestudy?
I have a friend, an adoptive mom, that says the state has to provide a copy when requested by a lawyer. Does anyone know if this is true?
What law mandates this?
I have been looking all over the Internet for this information. If anyone can guide me, I would appreciate it.
Thanks,
Jules
One thing to remember with a state homestudy is that you did not pay for it. The state paid for it. Therefore in many states, that means the state owns the homestudy and can give it out or not give it out as it pleases.
I know NJ will have its own laws, but there are states where they give you your homestudy no matter what, others where they give it to you only if/when the law requires it, others where you can purchase a copy of the homestudy from the state, and others that never give you a copy for any reason ever.
No help with NJ laws, but hopefully some insight into why you may not be able to get it. Good luck!

I received a copy of my homestudy a few weeks back. Just as I suspected, DYFS (or any other agency) has no legal right to withhold the homestudy from you. When I originally made the request to my social worker, he told me
"no." I told him I anticipated that response and would need to speak to his supervisor. He immediately changed his tune, told me to submit my request in writing and a few days later, I had my HS. Talk about thrilled! I am using my HS for an out-of-state placement, DYFS has been nothing but an 18 month nightmare. The whole situation borders on absurd especially since they are now trying to get me to accept an in-state placement.
