Hi.
Our beautiful son was placed with us in October of 2004. Unfortunately we didn't look into any of the tax credits or child dependent laws to see if we needed to do anything in advance of doing our taxes.
So, here we are, a week before our appt. to get our taxes done. I finally look at the paperwork and see that we need either a Social Security Number or Temp. Tax ID number for him. After realizing that it will take forever for the Temp. Tax ID number, I gather all my paperwork and head down to sit in the SS Office. I figured it was a long shot but I had nothing to lose.
Well, after three different manager coming over and trying to sort it all out, they were able to assign my son a SS card!!! WOOHOO!!! We don't finalize until this spring so I thought we wouldn't be able to appy for the ss card. They accepted the documents from the court stating that both parents rights were already terminated. Then they used the agency's document where it states we have custody. They told us we should receive his card in the mail in a week or two.
I hope this helps someone else out and it's worth a shot rather than waiting 4-8 weeks for the temp. tax id number.
**Editted to add that the SS card will have his birth name (which was ok for us since bmom gave the name we planned on using) and have his last name changed when the adoption is finalized.

We tried several ways to get either SS# or TIN#, with no go... they basically said tough luck you gotta wait until you get the brith certificate. So we filed taxes and will file amended taxes once b.c. gets here and we get ss# with that. Argh, how frustrating!

Why would you have needed the birth certificate for filing the W-7A form for an ATIN? Is your child not a US citizen yet? That is the only reason I could find that would prevent you from filing. If your child was born domestically any number of documents are accepted by the IRS to support intent to adopt and dependent status. Guess with tax day so soon, it's a moot point and you'll have to file an amended return as you plan.
We've adopted seven times....two have been domestic infant adoptions. Two have been international infant adoptions (years ago)...and three have been older child adoptions.
We have never been able to get a SSN without having the finalization completed first ----then receiving the birth certificate.
Our own adoption attorney has advised against Temporary numbers, as she believes it adds more headaches than not. In regards to getting the SSN....we have always changed our children's SSN's when applying. You don't have to.....but it's often considered good policy in many cases.
I am surprised that you were allowed to get a SSN----but with the original birth name on it. Good luck for you!
