I am attempting to use the Nolo guide to do our own adoption. I am concerned that the alleged father is going to say that he is not the bio dad. In the book it says that he can consent by signing either the Denial or the Waiver. Does anyone know anything about this? Do I have to have a termination hearing or can I just file the papers with the court? Do these papers need to be served to him, or can I just mail them? We are in Orange County. I would really appreciate any input!

What you need to do is contact the social services or probation department (whoever it is that does the home study and fingerprinting) and find out from them what papers you need to file in your case. They will walk you through it so that you file things properly. If he denies paternity it is the same thing as giving up any rights he may have to the child...read that part in the book and make sure I'm right about that. I don't have my book with me right now or I would look it up.

Thank you very much for your response. I am also wondering if we will need to have a termination hearing if I have a Denial of Paternity (or a Waiver). Maybe I could just file those forms with my adoption request ...?
Does anyone else feel like a total moron when they call the Social Services office? I feel like they must be thinking, "Here we go, another do-it-yourselfer..."
