I am remarried and my husband would like to adopt my son. His biological father is alive and has contact with him.He didnt pay child support for five years until the state took his disability checks. We have joint legal custody with me having sole physical custody. There is a question of his paternity but Iam not sure how to go about having this checked or if after 9 years of thinking he is the biological father, it would make any difference to a court now. Can his parental rights be ended if paternity shows he is not the father, even after all these years> and if not, can my husband even adopt our son with the father in the picture? There are several circumstances that are very bad for our son to be around>drugs etc. Anyone who has some options for me, please email me.

Melanie, I have heard that if a parent has absolutely no contact with the child for 2 years, this means, support,talking, visiting, ect. that by law, they have to give up their rights. My son hasn't seen his father in 2 years, but he pays child support through the DA's office. I'm looking to have my husband adopt my son. Does your ex see your son?
