What happens when a possible birthfather who is contesting an adoption does not show for the court ordered dna test? I know he could be held in contempt of court, but what happens as far as the adoption procedure..Please if anyone could let me know I would appreciate this very much.
Hi there. I don't know the answer to this but I do have a legal background and could make a few guesses. My first guess would be the Judge might be nice and let the guy have another chance. My next guess would be that the contest may be thrown out since it is appearing that birthfather is having second thoughts. It sounds like whatever the outcome, it will be in your favor.

That is what we are so afraid of...the judge giving him another chance.We have had the baby since birth and he is 9 months old...the thought of losing him is just too painful to even think about.As I know all state laws differ...in our state we had to pay for the dna testing..all this guy had to do was show up.Soon our court hearing will be and the judge court ordered the dna test to be done before this hearing.We were told this will all be up to the judge as to the outcome.I just keep praying that is what has gotten us through this so far...
I was in a similar situation 2 years ago. My son's birthfather would not go for the DNA-in my state he had to pay. The judge gave him an extra 2 weeks to get it done, and he didnt. He was given a total of 6 months to do this. The judge finally did the TPR on the grounds of abondenment since he never went for the test....Good luck
