My brother, Rob was adopted in Rockland County, NY when he was 2 years old he is now 20. My mom knew his foster mom because she went to school with their children, so she allowed my mom to keep in touch and visit over the years. On 12/23/05 Rob was involved in a drunk driving accident with two of his friends. The friend that was driving was intoxicated, and to my understanding so was the other passenger and my brother. The two suffered minor injuries, and were treated and released, the driver has not been seen or heard from, he was never arrested. My brother suffered the worst injury he had major brain trauma and blood clots on his brain that were removed on Sunday. His condition has stabilized, but he remains in intensive care. My question is really for my mother. His foster mother is unable to care for him anymore because she is elderly and legally blind. Her house is literally in shambles and surrounded by drugs, she has lost about 3 of her biological children to drugs and her surviving daughter is a drug addict herself. My mom is worried that if he is permanently brain damaged and needs to be placed somewhere for care, does she have any rights in making this decision? We are just worried and do not want him returning to that home or the negative life he led with the people he called friends. He didn't graduate high school, has been arrested and been to jail, and was recently in a fight and was stabbed. My mom and the rest of our family just wants a better life for him if he does manage to recover from all of this, but what we want to know is, does she really have any say so? She lives in NJ so we do not know if we would have to abide by NY or NJ laws, if anyone has answers they are greatly appreciated.
