She said no to us adopting "our" child. We were not even aware there was a prosecutor involved. Anyway, our court session was 2 and a half hours long. 90% of the time was spent questioning me on homeschooling.
She thought our family was too large, and she didn't understand homeschooling, and didn't think we could handle a special needs child with the type of environment we would be providing her.
The judge asked for us to bring documents verifying that homeschooling is in fact, legal, in America, and that we are abiding by our state's laws concerning it. This is in the hopes that the documentation will appease the prosecutor and that she will reverse the decision to deny us.
We have court again on Monday. Just wanted to let you know how it went. Prayers would be welcome.

Prayers going up for you. Maybe it would help if you assured them that if her needs were not being met at home you would seek out help or even a school if she needed it.
Try HSLDA, as well as your local state's umbrella organization. Oh, not to mention the link to what's going on in Poland for their home educating families. I'd put links, but have lost track of what we are and are not allowed to share here. If there is anything about our adoption that we can send you to help, let me know. Our home study (I think I still have a copy) talks about our being home educators. We are also due for another home study in the next few weeks. While it wouldn't be until after your adoption, if the judge wants it to see that there are other children being adopted by home educating families, and that they are doing great, we'd be happy to get him/her a copy of the original study, our referral (in which the boys were a mess) and a new home study update (which will show they are off all medication, and doing great). I know I'm grasping at straws here but wow . . . such rediculosity . . .

I'm really sorry to hear that. I hope the judge reconsiders when you bring in more info. Just FYI - I remember reading an article in a recent edition of the Polish Newsweek about home schooling and how it's becoming more popular in Poland now too. Wonder if your lawyer could get a copy and bring to the trial. Best of luck!

Oh my heart goes out to you. You and your family are most definitely in our prayers. How about a letter from the school for the visual impaired that would attest to services available to you in your home and at their school? What were the recommendations of the psychologist and the legal guardian? Can they make a stronger argument? Did you speak to your lawyer about the process -- does the prosecutor have to agree or will the judge make the decision based on all the information? I know the judge generally agrees, but we were told that the judge can override the prosecutor -- in our case the concern was the judge was more stringent than the prosecutor.
