What can CPS do when several kids have been removed and TPR'd (somewhat recently) and the birthmom is pregnant again? One birthmom told me that her lawyer told her to flee the county and she's likely never get caught. CPS knows about the current pregnancy but as far as I know nothing is being done. Can they not really do anything until she gives birth? and if so, then what? Can they enforce prenatal care when previous babies didn't have prenatal care?

As far a CPS knowing and not seeming to be doing anything. I would bet that they have alerted all area hospitals to keep an eye out for her. The hospitals will then notify CPS if/when she goes to them for the birth. CPS will then send a worker to the hospital to interview the mom and hospital personnel.
Depending on what the other children were removed and tpr'd for the mom may get a chance to work a caseplan. Then again, depending on the circumstances CPS may elect to not offer services or to offer only limited services for a specified amount of time. In many cases, if mom is offered a caseplan the child will be placed into foster care.
As to prenatal care. No, CPS cannot force her to have prenatal care if she chooses not to.

There really isn't anything they can do before the baby is born. If there were, we would see lots of BM's in facilities that make them stay clean and sober until their babies are born. CPS will usually have people on their radar if they have lost previous children to TPR. In my county, CPS will alert the hospitals here and in the surrounding counties about the Mom. If the Mom/baby tests negative for drugs at birth, then CPS will not take the baby, but may instead put a watch on her with occasional visits from a SW and track whether she is taking the baby to the dr., has housing, etc.
The parents of my former Fkids are on a watch with CPS. The state gave them visits in return for a voluntary TPR. Because they signed, any future kids are put on watch instead of being taken at birth. If they had not signed, CPS could have taken the baby by claiming eminent danger(which the baby would be in form these parents). The parents do not know this is what CPS is doing, by the way.
I find it hard to believe that any lawyer would tell a client to flee. Sounds like something the Mom just made up, especially if this is a state appointed lawyer.
They will be filing TPR on our fkids in a month and we just found out (90%) sure mom is almost 6 months pregnant. She has it on her myspace page and suddenly has baby items at her place that she says is for a friend.
She told our fd awhile back mommy was going to have another baby but when DFS questioned her she said Oh i was just playing I'm not pregnant. I showed their caseworker the myspace and she said there is nothing they can do except alert the hospitals to do a drug test when baby is born. If nothing shows in babies system they wont take it. I am sure as others have said they will watch her and the new baby but I think she will run or hide it and keep saying there is no baby.

Theresa Winters has spent almost half of her life having babies, but has not been allowed to keep any of them beyond the age of two. Even her own sister believes that she should be sterilised.

In my area, they wont even alert the hospitals b/c in their eyes the baby is NOT a baby until born. We tried to get them to do something about FS's (1)biomom b/c she was not receiving prenatal care for him & had a very serious medical issue that could have possibly killed him. But nothing was done b/c they said that our state laws do not recognize a baby until it is born.

I find it hard to believe that an atty told the bio mom to flee...but i'm sure some of her friends might have. Thats exactly what happened to our children's bmom. Shortly after they came into care, she found out she was preg. and fled to a differnt state to have the baby. She never did return to our state and was TPR'd on default. Sadly, she had the baby, was in a shelter and lost that baby. And because she was in a differnt state, the cw's here wouldn't even look for the baby. So now our children have at least one 1/2 sibling we know of that they'll probably never see and who knows how many more?

Here, they won't do anything. Unless there is evidence that birthmom has abused the new baby, and that is after it is born, then they will not do anything. Sometimes they take babies away if there are drugs in their system at birth, but they do not always. Prenatal care is a non-issue, they don't consider it at all. Even with an open foster care case they still let the birthfamily take the new baby home, regardless of housing situtation and current case plan. I wish they would notify hosipitals around here, but they don't even do that, it is only if the hosipital SW makes the first call with anything be done, and not even always then. It is sad.
It honestly depends what state you live in. I am in NJ and my son was taken from his mother at birth because she had another child in care. They had been giving her drug tests while she tried to work her plan for the little girl when they found out she was pregnant. She did tesst positive for drugs while pregnant but my son was not born with drugs in his system.
She did try working her plan for him but one day she just disapeared. We thought she may be pregnant and sure enough I got the call nine months later that she had given birth in another part of NJ. Somehow they ran her name at the hospital and it came up so they took the new baby too. She was also drug free at birth but probably exposed in the womb.
And even after my son and the older girl had separate TPR and adoption dates, they still had to work the case for my daughter. They didn't just terminate both. In fact mom never showed up at any court dates for my DD, and the judge still gave her more time to try and appear. She never did come back.

It actually varies depending on county. My county worker told me if TPR was done on a mom, they would consider any other child born to be in danger and take the baby from the hospital. However, my kids' first mom gave birth months ago, and the county handling TPR had already decided to allow her a chance to parent. But that was a nonissue anyway, as she changed counties before the birth. The county she currently is in will now have to offer her services if they get reports on her not caring properly for this child. Based on what I know of her past care of my children, and what I have witnessed in visits since the baby was born, phone calls to DHR will probably start soon. Since we live hours away, I think the new county will place the baby in foster care there to facilitate visits. But if she needs permanent care, we hope we will be able to adopt her.
