Has anyone else seen this? It appears that even if you don't owe a tax liability, the IRS will refund your credit amount. Am I really reading that correctly??? Please let me know if you have any other insight on this.
AGCI is pleased to let you know that Congress recently voted to extend the Adoption Tax Credit through 2011. Joint Council for International Childrens Services summarize the changes as follows:
The maximum credit was increased from $12,150 to $13,170
The credit is extended through December, 2011
The credit was made refundable. If a family has no tax liability, the IRS will refund the amount due
Families may become eligible for the Adoption Tax Credit in the tax year that they finalize an adoption of an eligible child. All we had to submit was the adoption decree.
YOU MUST FILE A PAPER RETURN. We got our refund in 30 days.
You can continue to carry over the credit until you use it up.
The credit starts getting reduced if your AGI is over 166,000, but don't hold me to the exact number.
You can also claim a foster child as a dependent if they were in your home for more than six months. we successfully fought a birth family that tried to take the credit. All we had to produce was the placement papers.You can also take the child care credit if both you and your spouse work.
I didn't file a paper return (that I remember) and didn't have to provide proof of the adoption. I gave his SSN and full name and said he was adopted.
I will say it was years ago that I got the credit (when it carries over it just copies the info from the last year) so I might be off - but I KNOW I didn't send a copy of any adoption paperwork and I'm 99% sure that I haven't ever filed paper taxes in the past 8 years - I've always filed online....

I think it was my H&R Block tax software that told me I had to file a paper return after I tried to file electronically, and we had SS numbers.
Hi, I am sorry to be so dense, but as with the poster above, the tax credit may make or break our decision, so I want to be sure I understand. I'm going to use some made-up numbers because I think I'll understand better!
If we make $81,000 a year, and have a tax liability of $7,000, usually pay $10,000 in taxes throughout the year (getting a $3,000 refund), and finalize an international adoption in July 2011, spending $23,000...when we do our taxes in January 2012, will we get the whole $13,170 back+the $3,000 we usually get back from paying too much throughout the year? In years past, we could have only gotten $7,000 each year until we reached the total credit limit? I am sorry to be so dumb, but I want to make sure I understand.

We are considering starting our second adoption (healthy child) now (Sep. 2010), but, because of all the possible delays, we may not be done by Dec. 2011. As it stands right now, that would mean no tax credit, correct?
Does anybody know if any work is in progress in D.C. to try and extend the tax credit beyond 2011?

I know les and less on the subject. I was simply trying to find out if we qualify for special needs adoption. The state wrote to say, we arern't qualified for the stipend as she is currently healthy and getting all her needs met, but we are accepted into the program, with file flagged ror review should she need it. So, she's both special needs and not. :p

This is my current nightmare too! Currently healthy but born exposed to drugs...so no telling for the future. No one can seem to tell me yes or no. My current understanding is that if a child doesn't qualify for a title IV-E subsidy they do not qualify for the tax credit as a special needs child. I have NO idea if that is true or not! Sorry I'm not more help, I'm hoping someone else out there has adopted a healthy foster child and can tell us!
Hi I'm new here and we are just looking into adoption. I had a question for eagleswings216 or anyone who would like to contribute. I see that you adopted twin infants. I am really interested in adopting twins, but wasn't sure if it would be too difficult to find. Did you have to wait a along time? Also, if anyone has any recommendations for an agency in southern California it would be greatly apprecitated. Thank you!
Just wanted to throw this out here.......
Earlier in this thread, I'd asked if previous adoption tax credits (carried forward) would now be 'refundable credits'. I think someone said, 'no'.
On another adoption site, this link was posted which states (according to this information) any credit carried forward PREVIOUS to 2010 WILL BE CONSIDERED as a REFUNDABLE credit. The link gives separate scenarios about this.

All this to say that ACCORDING to this IRS publication, monies that we've carried forward (those that are still viable within that 5yr period TO carry forward) WILL be refunded to us. (About time, IMO.)
I hope this is true....and let's hope it helps out those who are hoping to adopt as fees are ridiculously high!!!!!
(Personally, I wish the credit had never been started. It gave some agencies/attorneys excuses to raise their fees 10K more and up!)

We are just starting the process of adoption and our business is a sole propritorship. One of our friends adopted a few years ago and said they were ineligable because they were small business owners. Any truth to that then/now?
We own a small business as well (as in my husband and myself and the kids are the employees :clap: ) and we've always been eligible for the credit. We haven't been able to use much of it though due to our other deductions, so I'm really looking forward to the refund before we lose our previous credits. I'm not an accountant though, so it doesn't hurt to check with a professional. :) Good luck on your adoption!

I think what your friend probably meant is that he couldn't use the credit because his small business deductions brought his tax liability down to $0. Now that the credit is refundable, though, it doesn't matter what other deductions you have.

Now that the credit is refundable, though, it doesn't matter what other deductions you have.
It's also possible that they had a self-employment tax liability; prior to this year, the credit was limited to income tax liability only and could not be applied to SE tax. But now that the credit is refundable, any excess credit can be used to offset other taxes due (SE taxes, early withdrawal of pension, etc.)

:wings: we adopted our two girls two years ago, when the credit was not cash refundable. now it is. we filed feb.22 and got our normal tax refund back and i checked the irs web for our return status it said our file was being reviewed and that we should be getting a letter requesting more info. and that we will have to submit within 30 days and that was two weeks ago and i still have not recieved any letter, but i dont know what more the could want when we filed i submitted every court document letter everything!! is this normal? should i be worried? what should i do if anything? thank you!!

Totally normal, they are reviewing MOST of the ATC's.
