This is actually for a friend...we finalized last November...but, does anyone know...does the state have the right to set up a visit between the birth parent(who relinquished her rights) and the kids she relinquished? Friends of mine signed an OA last year, but because of issues with the birthfather(who is being TPR'd) they have not been able to finalize. At this stage, a visit would be awful for the kids anyway...so, they were not going to push it. They were waiting for finalization...which is when the agreement is approved by a judge and enforced by the court anyway. My understanding is that the OA is not legal and binding until it has been filed in court. And, in our case, they treated us, as the Adoptive parents...as the ones best suited to decide the best interest of the kids, etc. Even BEFORE we finalized...but, now they are trying to bully these Adoptive Parents into a visit between the kids and their birthmom who relinquished her rights over a year ago...on top of that, the OA said she had to contact the Adoptive parents via their PO Box, and she has not done that...this is being done via the Caseworker for the kids!?!?!?! No one agreed to third party contact! Has anyone heard of this? Why would they undermine the adoptive parents like this when these folks have had the kids for years and everyone agrees they are the best placement...the kids aren't going anywhere...but, they are treating these people like straight foster parents, rather than the adoptive parents they are! The *only* parent who has any rights at this point is the dad..and TPR has been filed. The mom has no rights. Why would the state get in the middle like this?

We finalized our AD adoption with a OA and the OA agreement was done before the rights were termed for both bios but now we only have to do written letters/pictures for the bio dad as he failed to meet for the one visit we agreed on and we had the OA agreement written so if either or both bios don't show the contact becomes null and void, same for the letter/pictures if they come back to the lawyer it is done. I know the bio mom has had her lawyer contact our lawyer and she has tried to get more visits, and we have denied each one other then the one a year, and for our AD after seeing her bio mom she peed her pants at random for over 2 weeks so there is no way we would want to have to have her see this person any more if this is the reaction she gets... she/or you may want to talk to your lawyer as I have no idea why anyone else would be involved including the state as once we did the adoption the state was completely out of the picture.... so they should not be involved at all....??? talk to your lawyer they may be able to help you and get it all resolved. good luck!
