While child support is not considered contact in all states, you will still need to notify your ex of your intent to complete a stepparent adoption. He can either consent to the adoption, willingly terminating his parental rights to the child, or he can contest the adoption, appearing in court and fighting the adoption. If he chooses to contest, he is going to have to explain to the courts why he has not been involved in the child's life for the past seven years. Just because a parent contests an adoption does not mean that the adoption will not happen. It makes the process longer, and cost more, but a judge can still terminate parental rights if he or she sees fit, and award the adoption.
