I have a granddaughter (1 yo) and her two sisters (3 & 5 yo) in foster care in Pennsylvania X 19 months and just found out. September 11, I found out with a message on my machine. For the last three years I have searched for her and her family. Dad (my son) has disappeared. Mom voluntarily terminated her rights, according to Child Services. I have applied for adoption and have asserted my visitation rights as grandpa, even though it took a court order, this last Friday.
The question is; does anyone know of case law that gives me a standing above the foster parents to adopt my granddaughter and her sisters?
My attorney is researching the issue and we all have an intuitive notion it SHOULD be true but no specifics.
