My husband wants to adopt two of my children. Their father has not seen them in 9 years, since he went to jail for shaking our son when he was baby. My ex is also a registered sex offender. Does anyone know if I would have to ask him if my husband can adopt my children? There is also a "No Contact" order in place, so we can't contact each other. With him being a sex offender, he can't be around children. To top this off his sister has court ordered visits with the children, and I would like to stop these. I live in Indianapolis and he lives in Florida. He is also $30,000 behind on his child support. My children now about bio father, but don't want anything to do with him. Any help with this is grateful.
I would get a lawyer invovled. They can make all the necessary contact with your ex. Also, they can get the courts to try to stop the sister's visits with the kids. The lawyers will end up sending a certified letter to your ex asking for him to sign over rights. If that does not work, ask if you can take him to court for with holding consent which is in the best intrest of the children.

As an FYI, if he hasnt seen his kids in 9 years you could probably terminate his rights involuntarily. As has been suggested, get a lawyer involved. Your lawyer can ask for consent, but have a back-up plan in case your ex tries to cause trouble... Your lawyer will help you with that too.
